ASSEMBLY BILL 1995 (KORETZ – 2006)

As enacted, Assembly Bill 1995 was a single-section bill that amended Government Code section 71660, relating to personnel files of trial court employees.  (See Exhibit #1c)  Assembly member Paul Koretz introduced this measure on February 9, 2006 on behalf of the American Federation of State, County and Municipal Employees, AFL-CIO.  (See Exhibits #1a and #10)

 

Assembly Bill 1995 was assigned to the Assembly Committee on Public Employees, Retirement and Social Security and the Senate Committee on Judiciary where policy issues raised by the bill were considered.  (See Exhibits #3, #5 and #8)  One amendment was made to Assembly Bill 1995.  (See Exhibits #1b and #2)  Subsequent to legislative approval, Governor Arnold Schwarzenegger signed the bill on August 28, 2006, and it was recorded by the Secretary of State on that day as Chapter 187 of the Statutes of 2006.  (See Exhibit #1c and #2)

 

The Office of Senate Floor Analyses Third Reading analysis of Assembly Bill 1995 summarized the bill as amended on April 17, 2006 as follows:

 

This bill requires a trial court to permit an employee, upon request, to inspect any personnel files that are or were used to determine the employee’s qualifications for employment, promotion, additional compensation, or termination or other disciplinary action.
