Assembly Bill 3703 was a single-section bill that proposed to amend Civil Code section 1950.5 only. (See Exhibit #1e) Assembly Bill 3703 was introduced by Assembly member Johnston on February 20, 1986. (See Exhibit #1a)
Assembly Bill 3703 was assigned to the Assembly Committee on Judiciary and the Senate Committee on Judiciary where policy issues raised by the bill were considered. (See Exhibits #3 and #7) Three amendments were made to Assembly Bill 3703 during the legislative process. (See Exhibits #1b through #1d and #2) Subsequent to legislative approval, Governor George Deukmejian signed the bill on August 24, 1986, and it was recorded by the Secretary of State on August 25, 1986 as Chapter 564 of the Statutes of 1986. DIGEST: This bill would permit a landlord to use a tenants [sic] security deposit to remedy the tenant’s failure to return personal property provided under the lease. (See “Analysis” for details.)
