SENATE BILL 441 (LOCKYER – 1986)

As enacted Senate Bill 441 was a single-section bill that amended Labor Code section 2870 only.  (See Exhibit A, #1d)  Senator Bill Lockyer introduced the measure on February 15, 1985 at the request of the Los Angeles County Bar Association.  (See Exhibit A, #1a and #3) 

Senate Bill 441 was heard and passed by the Senate Committee on Industrial Relations in 1985.  (See Exhibit A, #2 and #3)  The measure was then sent to the Assembly Committee on Labor and Employment where it was held, becoming a two-year bill.  (See Exhibit A, #2) After approval by the Assembly Committee on Labor and Employment, the Assembly Committee on Ways and Means considered the bill.  (See Exhibit A, #2, #9, and #11)

Senate Bill 441 was amended twice while in the Assembly.  (See Exhibit A, #1b, #1c, and #2)  Senate Bill 441 received unanimous approval of the Committees it was heard by, as well as the Senate and Assembly as a whole.  (See Exhibit A, #2) Governor George Deukmejian signed Senate Bill 441 on July 15, 1986, and it was recorded as Chapter 346 of the Statutes of 1986.  (See Exhibit A, #1d and #2)

This bill will clarify existing law with respect to rights of employees to maintain ownership of inventions that were developed on their own time and with their own resources.
