ASSEMBLY BILL 736 (HORTON – 2005)

Public Utilities Code sections 851 and 853 were amended with the passage of Assembly Bill 736 of 2005.  (See Exhibits #1a through #1f)  Assembly member Jerome Horton introduced this measure relating to the regulation of public utilities on February 17, 2005.  (See Exhibit #1a)  The Volcano Communications Group sponsored the measure.  (See Exhibits #6, page 2; and #8, page 1)

Assembly Bill 736 was assigned to the Assembly Committee on Utilities and Commerce and the Senate Committee on Energy, Utilities and Communications where policy issues raised by the bill were considered.  (See Exhibits #3 and #6)  The fiscal ramifications of the bill were considered by both the Assembly and Senate Committees on Appropriations.  (See Exhibits #4 and #2)  Five amendments were made to Assembly Bill 736.  (See Exhibits #1b through #1f and #2)  Subsequent to legislative approval, Governor Arnold Schwarzenegger signed the bill on September 29, 2005 and it was recorded by the Secretary of State on that day as Chapter 370 of the Statutes of 2005.  (See Exhibit #1g)
 

The Concurrence in Senate Amendments analysis by the Assembly Committee on Utilities and Commerce summarized Assembly Bill 736 as follows:

Modifies the California Public Utilities Commission's (PUC's) approval process for the sale or transfer of public utility assets by allowing public utilities to sell, or otherwise transfer property valued at less than $5 million if the transfer is approved by PUC through a 120-day advice letter process rather than through a formal proceeding.
