Assembly Bill 749 (Calderon – 2002)

Assembly member Manny Diaz introduced the measure on February 22, 2001. (See Exhibit A, #1a) As introduced, Assembly Bill 749 only proposed to amend section 3572.3 of the Government Code, relating to higher education labor relations. (See Exhibit A, #1a through #1d) In this form, the Assembly Committee’s on Higher Education and Insurance and the Senate Committee on Education considered the policy issues raised by the bill. (See Exhibit A, #3 and #9) The Assembly and Senate Committees on Appropriations examined the bill’s fiscal implications. (See Exhibit A, #5 and #11) While Assembly Bill 749 was being examined in the Senate Committee on Appropriations, the measure was placed in the inactive file on September 12, 2001. (See Exhibit A, #2)
Assembly Bill 749 was removed from the inactive file on January 30, 2002. (See Exhibit A, #2) On January 31, 2002, the measure was gutted in the Senate and used to amend, add and repeal numerous sections relating to workers’ compensation administration and benefits. (See Exhibit A, #1e) Assembly member Thomas Calderon was substituted as the author. (Id.) He carried the bill on behalf of the California Labor Federation and the California Applicants’ Attorneys Association. (See Exhibit A, #12b) Further amendments were proposed on February 4, 2002, and it was approved by the Senate and forwarded to the Assembly. (See Exhibit A, #1f and #2)
In the Assembly, Assembly Bill 749 was referred to the Committee on Insurance where policy issued raised by the bill were considered. (See Exhibit A, #5) The Assembly concurred in the Senate amendments and forwarded the bill to the Governor. (See Exhibit A, #2) Governor Gray Davis signed the bill on
February 15th, and it was recorded by the Secretary of State on February 19th as Chapter 6, Statutes of 2002. (See Exhibit A, #1h and #2)
A description of Assembly Bill 749 is noted in the Concurrence in Senate Amendments analysis of the bill as last amended on February 4, 2002 as follows:
Increases workers’ compensation benefits and implements cost-saving reforms in the administration of the workers’ compensation system.
