As enacted Senate Bill 728 added sections 18351 through 18368 to the Education Code. (See Exhibit A, #1f) Senator Richard Dolwig, an attorney representing San Mateo County, introduced the measure on January 17, 1957. (See Exhibit A, #1a and #5)
Senate Bill 728 was assigned to the Senate and Assembly Committees on Education where policy issues raised by the bill were considered. (See Exhibit A, #2) Three amendments were made to Senate Bill 728 during legislative consideration. (See Exhibit A, #1b through #1d and #2) Subsequent to legislative approval, Governor Goodwin Knight signed Senate Bill 728 on June 12, 1957, and it was recorded by the Secretary of State on July 8, 1957 as Chapter 2071 of the Statutes of 1957. Describing Senate Bill 728 as enacted, the Legislative Counsel, in its Summary Digest of Statutes Enacted, stated:
. . . (Ch. 2071). DOLWIG. Adds Art. 8, Ch. 3, Div. 9, Ed. C., re lease- purchase agreements covering school buildings.
Authorizes school districts to enter into agreements for construction of school building on district property to be leased to district for term not exceeding 40 years, at expiration of which title to building and site vest in district. Makes authorization subject to approval of electors of district and prescribes procedure for calling such election. Requires electors to authorize increase in school district tax rate to be used for such purposes of agreement. Provides that 60 percent of remaining payments under lease shall constitute outstanding bonded indebtedness for purposes of determining bonding capacity of district.
In effect until ninety-first day after final adjournment of 1961 Regular Session.
