ASSEMBLY BILL 2406 (LANTERMAN-1970)

Assembly member Lanterman introduced Assembly Bill 2406 on April 3, 1970.  (See Exhibit #1a)  Assembly Bill 2406 was a result of a study by the Assembly Select Committee on Mentally Ill and Handicapped Children.  (See Exhibit #5, document PE-10)   The bill only added Welfare and Institutions Code sections 5115, 5116 and 5117.  (See Exhibit #1g)

The measure was assigned to the Assembly Committee on Health and Welfare and the Senate Committee on Local Government that considered the policy issues raised by the bill.  (See Exhibits #2 and #3)  Assembly Bill 2406 was amended on five occasions, three times in the Assembly and twice in the Senate, prior to legislative approval.  (See Exhibits #1b through #1f and #2)  Governor Ronald Reagan signed the measure on September 16th and the Secretary of State recorded it as Chapter 1219 of the Statutes of 1970.  (See Exhibits #1g and #2)

The Legislative Counsel in the Summary Digest of Statutes Enacted presents the following digest of Assembly Bill 2406:
 

Ch. 1219 (AB 2406)  LANTERMAN  Adds Secs. 5115, 5116,
        5117, W. & I.C., re facilities for handicapped.
   Provides that designated facilities for the mentally or physically handicapped shall be considered as a residential use for purposes of local zoning.
   Directs the Secretary of Human Relations agency to develop plan not later than March 1, 1971, to consolidate specified functions of the Human Relations Agency.
