SENATE BILL 1605 (MARGETT – 2006)

As enacted in 2006, Senate Bill 1605 was a single-section bill that amended only Public Contract Code section 7104, relating to public works.  (See Exhibit #1c)  Senator Bob Margett introduced this bill on February 24, 2006 on behalf of the Engineering Contractors’ Association.  (See Exhibit #1a)

Senate Bill 1605 was assigned to both the Senate and Assembly Committee on Judiciary where policy issues raised by the bill were considered.  (See Exhibits #3 and #7)  One amendment was made to Senate Bill 1605.  (See Exhibits #1b and #2)  Subsequent to legislative approval, Governor Arnold Schwarzenegger signed Senate Bill 1605 on August 28, 2006 and it was recorded by the Secretary of State on that day as Chapter 183 of the Statutes of 2006.  (See Exhibit #1c)

A summary of Senate Bill 1605 as last amended on March 27, 2006 is set forth in the Assembly Committee on Judiciary’s Third Reading analysis as follows:

Clarifies when a public works contractor must notify a public agency, in relation to the change of soil conditions and makes conforming changes.  Specifically, this bill clarifies that:

1)    Sub-surface or latent physical conditions at the site must differ from information provided at the time of the bid in order to trigger the requirement that the contractor notify the public agency of this condition.

2)    Obligation pertains only to “local public agencies.”
