Assembly Bill 1974 (Pescetti – 2002)

Assembly Bill 1974 affected numerous Government Code sections relating to public employees retirement and risk pools.   (See Exhibit #1h)  The measure was introduced on February 14, 2002 by Assembly member Pescetti for the California Public Employees Retirement System.  (See Exhibits #1a and #8)

Assembly Bill 1974 was assigned to the Assembly Committee on Public Employees, Retirement and Social Security and the Senate Committee on Public Employment and Relations where policy issues raised by the bill were considered.  (See Exhibits #3 and #8)  The fiscal ramifications of the bill were considered by both the Assembly and Senate Committees on Appropriations.  (See Exhibits #5 and #9)  Six amendments were made to Assembly Bill 1974.  (See Exhibits #1b through #1g and #2)  Subsequent to legislative approval, Governor Gray Davis signed the bill on September 30, 2002 and it was recorded by the Secretary of State on that day as Chapter 1133 of the Statutes of 2002.  (See Exhibit #1h)

This bill facilitates local contracting agencies and school employers to participate in risk pools established by the State Public Employees' Retirement System (PERS) and provides that such participation will not impact the state's school funding formula.
