Assembly Bill 2234 (Wray – 1980)

Assembly member Chet Wray introduced Assembly Bill 2234, relating to land use, on January 31, 1980.  (See Exhibit #1a)  This measure added Civil Code section 798.17 and added Government Code sections 65863.7 and 66427.4 only.  (See Exhibit #1j)  The Golden State Mobilehome Owners League sponsored the measure.  (See Exhibit #17, document PE-1)


Assembly Bill 2234 was heard in the Assembly Committee on Housing and Community Development and the Senate Committee on Local Government where policy issues raised by the measure were considered.  (See Exhibits #2, #3 and #8)  The Assembly Committee on Ways and Means and the Senate Committee on Finance examined its fiscal implications.  (See Exhibits #2 and #5) 

Following seven amendments, four in the Assembly and three in the Senate, Assembly Bill 2234 was approved by the Legislature.  (See Exhibits #1b through #1h and #2)  When Assembly Bill 2234 was returned to the Assembly, the Senate’s amendments were rejected.  Consequently, Assembly Bill 2234 was assigned to a Conference Committee.  (See Exhibit #2)  The purpose of a Conference Committee is to bring together six legislators, three from each House, in an attempt to reach a compromise on a bill’s language that is acceptable to both Houses. 


The Conference Committee made amendments to Assembly Bill 2234 in a conference report which was accepted by the Legislature.  (See Exhibits #1i, #2, and #15)  Governor Edmund G. Brown, Jr., signed the legislation on September 10th and the Secretary of State recorded it on that date as Chapter 879 of the Statutes of 1980.  (See Exhibits #1j and #2)


A digest of Assembly Bill 2234 as it was enacted was provided in the “Enrolled Bill Memorandum to Governor” prepared by the Legislative Secretary as follows:

This bill would require that tenants of mobile-home parks receive notice of the zoning under which the park operates, the expiration date of any conditional use use [sic] permit governing the parks [sic] operation, and any changes in the zoning or use permits.
The bill also requires subdividers who plan to convert a mobilehome park to another use to file a report on the impact a conversion would have on the park’s tenants.
