ASSEMBLY BILL 403 (AGNOS – 1985)

CHAPTER 22, STATUTES OF 1985

As enacted, Assembly Bill 403 added Health and Safety Code sections 199.20 through 199.23, relating to health.  (See Exhibit A, #1f)  Assembly Bill 403 was introduced on January 24, 1985 by Assembly member Art Agnos.  (See Exhibit A, #1a)

Assembly Bill 403 was assigned to the Assembly Committee on Health and the Senate Committee on Health and Human Services where policy issues raised by the bill were considered.  (See Exhibit A, #3 and #8)  The fiscal ramifications of the bill were considered by the Assembly Committee on Ways and Means and the Senate Committee on Appropriations.  (See Exhibit A, #2 and #5)  Four amendments were made to Assembly Bill 403 during consideration by the Legislature.  (See Exhibit A, #1b through #1e and #2)  Subsequent to legislative approval, Governor George Deukmejian signed the bill on April 3, 1985, and it was recorded by the Secretary of State on April 4, 1985 as Chapter 22 of the Statutes of 1985.  (See Exhibit A, #1f and #2)

Assembly Bill 403 contained an urgency clause stating the following:

    In order to protect the confidentiality of persons undergoing a blood test for the detection of antibodies to acquired immune deficiency syndrome, and to encourage individuals who are stricken with the disease to undergo treatment which would ultimately benefit the health and welfare of all citizens of the State of California, it is necessary that this act take immediate effect.
