NEWS AND NOTES

SUPREME COURT DECISIONS:  You can hardly find more drama, shifting majorities, and national impact than today’s Supreme Court’s Patient Protection and Affordable Care Act (HR 3590 of 2010) decision in the case of National Federation of Independent Business v. Sebelius , the majority written by Chief Justice John Roberts, which upheld the federal law.  The Chief Justice delivered the opinion of the Supreme Court as to Parts I, II and III-C of the opinion, joined by Justices Ginsburg, Breyer, Sotomayor and Kagan.  The Chief Justice also delivered the opinion as to Part IV, in which Justices Breyer and Kagan joined, and an opinion as to Parts III-A, III-B, and III-D.  There were concurrences in part and dissents in part by Justices Ginsburg and Sotomayor, and Justices Scalia, Kennedy, Thomas and Alito filed a dissenting opinion.  You can read the opinion here .

Another opinion of note today is the Stolen Valor Act decision, with the majority written by Justice Anthony Kennedy, affirming the Ninth Circuit’s finding that the Act was invalid because it infringed upon speech protected by the First Amendment.  You can read this opinion here .
