Civil Code section 1584.5 was first enacted in 1969 following legislative passage of Senate Bill 323. (See Exhibit A, #1c) Senate Bill 323 was introduced by Senator Stiern on February 13, 1969. (See Exhibit A, #la and #2) The bill was a single-section measure that proposed to add section 1584.5 to the Civil Code only. (See Exhibit A, #1)
The measure was heard by the Senate Committee on Judiciary and the Assembly Committee on Commerce and Public Utilities. (See Exhibit A, #3 and #4) Senate Bill 323 was amended once during the legislative process. (See Exhibit A, #1b and #2) Subsequent to legislative approval, Senate Bill 323 was approved by Governor Ronald Reagan on June 27, 1969 and was recorded by the Secretary of State on that date as Chapter 265 of the Statutes of 1969. At the time that Senate Bill 323 was introduced, the bill proposed to add section 1584.5 to the Civil Code. (See Exhibit A, #1a) The only amended version of the bill proposed to add the second paragraph to section 1584.5. (See Exhibit A, #1b) This was the language that was enacted into law. (See Exhibit A, #1c)
An analysis of Senate Bill 323, as introduced, was prepared for the Senate Committee on Judiciary describing the measure as follows:
SB 323 adds Sec. 1584.5 prohibiting unsolicited sending of goods, etc., not actually ordered or requested by the recipient, either orally or in writing. It further provides that receipt of any such goods shall be deemed an unconditional gift to the recipient.
