Vehicle Code section 12810.3 was added, and Vehicle Code section 23123 was added and repealed with the passage of Senate Bill 1613 of 2006. (See Exhibit A, #1a through #1h) Senate member Joe Simitian introduced this legislation on February 24, 2006. (See Exhibit A, #1a)
Senate Bill 1613 was assigned to the Senate Committee on Transportation and Housing and the Assembly Committee on Transportation where policy issues raised by the bill were considered. (See Exhibit A, #3 and #8) The fiscal ramifications of the bill were considered by the Senate Committee on Appropriations and the Assembly Committee on Appropriations. (See Exhibit A, #5 and #10) Six amendments were made to Senate Bill 1613. (See Exhibits #1b through #1g and #2) Subsequent to legislative approval, Governor Arnold Schwarzenegger signed Senate Bill 1613 on August 29, 2006, and it was recorded by the Secretary of State on August 31, 2006 as Chapter 290 of the Statutes of 2006. The Unfinished Business Analysis by the Office of Senate Floor Analysis summarized Senate Bill 1613 as last amended on August 24, 2006, stating:
This bill prohibits, beginning July 1, 2008, a driver from using a wireless phone while operating a vehicle, unless the phone is specifically designed and configured to allow hands-free operation and is used in that manner and prohibits the use of a wireless phone while driving a schoolbus or transit vehicle, except as specified.
