Senate Bill 318 (Wolfe-1907)

Chapter 272, Statutes of 1907

Some bill research does not include the Governor's file because at the time we researched the bill, the sitting Governor had not released his chaptered bill file. If the Governor's file is not included with this particular research, please contact our office (1-530-666-1917 or quote@legintent.com) and we will be happy to provide this file at no charge if it is available. Please Note: Governor files did not exist prior to 1943.

As enacted, Senate Bill 318 amended Code of Civil Procedure sections 525 through 527 and sections 529 through 532, relating to injunctions.  (See Exhibit A, #1d)  Senate Bill 318 was introduced at the request of the Code Commission.  (See Exhibit A, #2)

Senate Bill 318 was assigned to the Senate Committee on Judiciary and the Assembly Committee on Revision and Reform of the Law where policy issues raised by the bill were considered.  (See Exhibit A, #2)  Two amendments were made to Senate Bill 318.  (See Exhibit A, #1b and #1c)  Subsequent to legislative approval, Governor James Gillett signed Senate Bill 318 on March 6, 1907, and it was recorded by the Secretary of State as Chapter 272 of the Statutes of 1907.  (See Exhibit A, #1d and #2)

Senate Bill 318 was a product of the “Report of the Commissioners for the Revision and Reform of the Law” published in 1900.  (See Exhibit A, #4)  The Commissioners were appointed in 1899 to study and recommend revisions to the California Codes.  (Id.)  This Report dealt specifically with the Commission’s recommendations regarding the Code of Civil Procedure and sets forth the sections that should be repealed, amended, or added.  (Id.)
