ASSEMBLY BILL 138 (BOATWRIGHT – 1973)

Assembly Bill 138 was a single-section bill that enacted Labor Code section 4607 only.  (See Exhibit #1b)  Assembly member Boatwright introduced the bill on January 23, 1973 at the request of a constituent attorney and was supported by the Applicants’ Attorneys Association and the California Trial Lawyers.  (See Exhibits #1a and #4)

Assembly Bill 138 was assigned to the Assembly Committee on Finance and Institutions and the Senate Committee on Industrial Relations where policy issues raised by the bill were considered.  (See Exhibits #3 and #4)  The fiscal ramifications of the bill were considered by the Assembly Committee on Ways and Means and the Senate Committee on Finance.  (See Exhibit #2)  No amendments were made to Assembly Bill 138 during the legislative process.  (See Exhibit #2)  Subsequent to legislative approval, Governor Ronald Reagan signed the bill on September 21, 1973 and it was recorded by the Secretary of State on that day as Chapter 663 of the Statutes of 1973.  (See Exhibits #1b and #2)

The Summary Digest of Statutes Enacted published by the Legislative Counsel provides the following summary of Assembly Bill 138:


    Authorizes Workmen’s Compensation Appeals Board to assess as costs against moving party the attorney’s fees of injured employee who successfully defends proceedings instituted to terminate employee’s award for continuing medical treatment previously made by appeals board.
