ASSEMBLY BILL 2160 (HARVEY – 1993)

As enacted, Assembly Bill 2160 affected various sections of the Health and Safety Code, relating to alcohol and drug programs.  (See Exhibit #1f)  Assembly Member Harvey introduced this measure on March 5, 1993 on behalf of the Department of Alcohol and Drug Programs.  (See Exhibits #1a and #9b, page 1)

Assembly Bill 2160 was assigned to the Assembly Committee on Insurance and the Senate Committee on Health and Human Services where policy issues raised by the bill were considered.  (See Exhibits #3 and #7)  The fiscal ramifications of the bill were considered by the Assembly Committee on Ways and Means and the Senate Committee on Appropriations.  (See Exhibits #2 and #3)  Four amendments were made to Assembly Bill 2160.  (See Exhibits #1b through #1e and #2)  Subsequent to legislative approval, Governor George Deukmejian signed the bill on October 2, 1993, and it was recorded by the Secretary of State on October 4, 1993 as Chapter 741 of the Statutes of 1993.  (See Exhibits #1f and #2)

The Summary Digest, prepared by the Office of Senate Floor Analyses summarized the provisions of Assembly Bill 2160 as follows:

Amends the Health and Safety Code regarding licensure of alcoholism or drug abuse recovery and treatment facilities to (1) clarify the criteria for licensure and service components required to maintain licensure; (2) identify penalties for noncompliance with licensure requirements; and (3) make clarifying technical amendments to the code.
