Makes numerous substantive changes to provisions of law regarding individuals with exceptional needs and special education and related services to conform to federal special education regulations.

 

California must bring provisions of state law into conformity with federal law and regulations in order to assure continued eligibility for federal special education funding.

 

According to CDE, the instructions for filing for the state's $1.13 billion federal grant for the provision of special education to students with special needs state that, "States are required to ensure that their State policies, including statutes and regulations, are consistent with the final Part B regulations. States should make every effort to revise State policies consistent with their assurances provided in the 2006 Application for funds and the final regulations issued August 14, 2006."

 

This bill includes substantive revisions to special education statute which are in strict conformity with federal law and regulations and no new mandates are created by the provisions of this bill.
