SENATE BILL 12 (LOWENTHAL – 2007)

Government Code section 65584 was amended and Government Code section 65584.04 was added and repealed with the passage of Senate Bill 12 of 2007.  (See Exhibit #1d)  Senator Alan Lowenthal introduced this measure, relating to existing and projected regional housing needs, on December 4, 2006.  (See Exhibit #1a) 


 


Senate Bill 12 was assigned to the Senate Committee on Transportation and Housing and the Assembly Committee’s on Local Government and Housing and Community Development where policy issues raised by the bill were considered.  (See Exhibits #3, #6 and #7)  Two amendments were made to Senate Bill 12 during the legislative process.  (See Exhibits #1b, #1c, and #2)  Subsequent to legislative approval, Governor Arnold Schwarzenegger signed Senate Bill 12 on April 10, 2007, and it was recorded by the Secretary of State as Chapter 5 of the Statutes of 2007.  (See Exhibits #1d and #2)


 


Senate Bill 12 contained an urgency clause which caused the bill to go into immediate effect.  The reason for this urgency can be found in section 3 of Chapter 5 wherein it states:


 


            In order to allow the Southern California Association of Governments, at the earliest possible time, to develop a final allocation plan for distributing the existing and projected regional housing need to cities and counties within its jurisdiction on or  before the June 30, 2001, deadline imposed under existing law, it is necessary that this act take effect immediately.
