Senate Bill 998 was major education reform legislation that affected hundreds of sections of the Education Code as well as some Election Code, Government Code, Public Contract Code, Public Resources Code, and Welfare and Institutions Code sections. (See Exhibit #1f) Senate Bill 998 was authored by Senator Gary Hart, who served as chair of the Senate Committee on Education at this time. (See Exhibits #1f and #14, document A-6)
Senate Bill 998 was introduced as a skeleton bill, meaning it had only token substantive provisions; it was introduced to get a bill pending before the Legislature within the time limit for introduction of bills on the assumption that substantive amendments would be added later when they were completed. (See Exhibit #la) Following its introduction on March 4, 1987, Senate Bill 998 was assigned to the Senate and Assembly Committees on Education where policy issues raised by the bill were considered. (See Exhibits #3 and #8) The Senate Committee on Appropriations and the Assembly Committee on Ways and Means examined the bill’s fiscal implications. (See Exhibits #2 and #10) Four amendments were made to Senate Bill 998, twice in each house. (See Exhibits #1b through #1e and #2) The substantive amendments first appeared with the Senate amendments of April 8, 1987. (See Exhibit #1b)
Subsequent to approval by the Legislature on September 11, 1987, Governor George Deukmejian signed the bill on September 30, 1987 and it was recorded by the Secretary of State, on that date, as Chapter 1452 of the Statutes of 1987. (See Exhibits #1f and #2)
In a letter to Governor Deukmejian, Senator Hart explained that Senate Bill 998 was based on a study of existing Education Code provisions authorized by Senate Bill 57 of 1985. (See Exhibit #14, document A-6; see also Exhibit #3, page 1) This study was completed in August of 1986. (Id.) We include a copy of the Preliminary Draft and Final Report from this study. (See Exhibits #18 and #19)
The Senate Committee on Education analysis indicated that the purpose of the study was to provide recommendations to:
. . . enable the Legislature to identify methods of relieving the governing boards of school districts and county offices of education of the administrative burden of seeking waivers of inappropriate provisions of the Education Code, and to afford the governing boards and county offices flexibility in the implementation of education policy and programs.
