ASSEMBLY BILL 2383 (BADHAM – 1933)

As enacted Assembly Bill 2383, a single-section bill, only amended Civil Code section 3369 relating to specific and preventive relief. (See Exhibit #1c) Assembly member Willard E. Badham introduced the legislation on April 21, 1933. (See Exhibit #1a) Assembly Bill 2383 was heard in the Assembly and Senate Committees on Judiciary. (See Exhibit #2) The bill passed quickly through the Legislature without amendment and was approved on May 19, 1933, twenty-one days after it was introduced. (See Exhibits #1b, #1c, and #2) Following the approval of Governor James Rolph, Jr., Assembly Bill 2383 was recorded by the Secretary of State on June 15th as Chapter 953 of the Statutes of 1933. Unfortunately, neither the committees hearing this bill, its author, nor the governor have left documentation addressing the background and intent of this bill which has survived. The contemporaneous documents we have been able to locate are excerpts from Western Advertising, a periodical serving the advertising industry. (See Exhibit #4a)
