As enacted, Assembly Bill 2595 affected numerous sections of the Health and Safety Code, which enacted the “California Clean Air Act.” (See Exhibit #1k, pages 4415 and 4416) Assembly member Byron Sher, serving as chair of the Assembly Committee on Natural Resources at this time, introduced the legislation on March 6, 1987. (See Exhibits #1a and #3a, page 1)
The bill was heard in the Assembly Committee on Natural Resources and the Assembly Committee on Ways and Means. (See Exhibits #3 and #5) Assembly Bill 2595 was amended twice in the Assembly. (See Exhibits #1b and #1c and #2) After passing out of the Assembly in a brisk three and one-half months, the bill was assigned to the Senate Committee on Governmental Organization where it languished for an entire year while the author attempted to meet the demands of the mounting opposition. (See Exhibits #2 and #12, documents SFA-59 and SFA-64)
The measure was finally heard before the Senate Committee on Governmental Organization and the Senate Committee on Appropriations. (See Exhibits #2 and #7) Assembly Bill 2595 was amended on seven occasions in the Senate prior to approval by both Houses of the Legislature. (See Exhibits #1d through #1j and #2) Governor George Deukmejian signed the legislation on September 30, 1988 and the Secretary of State recorded it on that date as Chapter 1568 of the Statutes of 1988. (See Exhibits #1k and #2)
The Third Reading analysis of Assembly Bill 2595 as last amended prepared by the Office of Senate Floor Analyses described the bill, stating:
DIGEST: This bill requires state and local agencies to take various actions to reduce air pollution emissions from motor vehicles, revise air pollution plans, broaden local fee authority, increase air pollution penalties, and reduce transport of air pollution.
