Civil Code sections 54.1 and 54.3 were amended in 1976 following legislative passage of Senate Bill 2062. (See Exhibit A, #1c) Senator Alan Robbins introduced Senate Bill 2062 on March 29, 1976 at the request of the National Federation for the Blind. (See Exhibit A, #1a and #3, page 2)
While before the Legislature, the measure was considered by the Senate Committee on Health and Welfare and the Assembly Committee on Judiciary. (See Exhibit A, #3 and #6) One amendment was made to Senate Bill 2062. (See Exhibit A, #1b and #2) Senate Bill 2062 was approved by the Legislature on September 14, 1976, signed by Governor Edmund G. Brown, Jr., on September 15, 1976, and recorded as Chapter 971 of the Statutes of 1976. (See Exhibit A, #1c and #2)
In his Press Release regarding Senate Bill 2062, Senator Robbins gave the following description of the reasons why he carried this bill:
Legislation giving blind persons with guide dogs the right to rent or lease property where there is a restriction against animals has been introduced by State Senator Alan Robbins, D-San Fernando Valley.
. . .
“Many property owners already make exception for the blind, but writing this into state law will give them the proper authority to deny rentals or leases to the average tenant who also wants to bring dogs into a rental unit”, he added.
“To allow a blind person --- who must use a guide dog --- the same rights as a person who doesn't require a dog in getting about is obviously the humane course,” concluded Sen. Robbins.
