Senate Bill 970 is currently on the Governor’s desk awaiting approval. (See Exhibit #2) This bill proposes to add only Business and Professions Code section 13800, relating to rental vehicles. (See Exhibit #1d) Senator Ridley-Thomas introduced this measure on February 23, 2007 for an "unofficial" coalition of rental car companies including Avis Budget Car Rental, Enterprise Rent-a-Car, The Hertz Corporation and Vanguard Car Rental (Alamo and National). (See Exhibit #1a and #7, page 2)
At the time the bill was introduced the Senate proposed to amend Business and Professions Code section 12500(b) relating to weights and measures to add “‘Measuring instrument,’ however, does not include a fuel gauge installed in a motor vehicle by the motor vehicle manufacturer.” (See Exhibit #1a, page 2)
Senator Ridley-Thomas is chair of the Senate Committee on Business and Professions, which was the first legislative committee to review Senate Bill 970. (See Exhibit #3) The Senate did not propose amendments to the bill, and it was forwarded to the Assembly on May 14, 2007. (See Exhibit #2)
While in the Assembly, the Committee on Business and Professions considered the policy issues raised by the bill. (See Exhibit #7) The amendments made by the Assembly on June 19, 2007 gutted the bill and instead proposed to add Business and Professions Code section 13800, relating to rental vehicles. (See Exhibit #1b) This amendment was described as a “recast” of the bill into a new form. (See Exhibit #9a and #9b, page 2) One further amendment was made to the bill, proposing a new subdivision (b) to proposed section 13800. (See Exhibit #1d) The bill was then approved by the Assembly and Senate, and forwarded to the Governor where it awaits approval. (See Exhibit #2)
