Assembly Bill 3396 amended only Streets and Highways Code section 143. (See Exhibit #1b) Assembly Bill 3396 was introduced by Assembly member Baker on February 27, 1990. (See Exhibit #1a)
While before the Legislature, Assembly Bill 3396 was heard in the Assembly and Senate Committee on Transportation. (See Exhibits #3 and #9) The fiscal ramifications of the bill were reviewed in the Assembly Committee on Ways and Means and the Senate Committee on Appropriations. (See Exhibits #2 and #5) The bill was approved by both Houses without being amended and forwarded to the Governor on September 11, 1990. (See Exhibit #2) Governor George Deukmejian signed the bill on September 19, 1990 and it was recorded by the Secretary of State on September 21, 1990 as Chapter 1115 of the Statutes of that year. (See Exhibit #1b and #2)
Assembly Bill 3396 contained an urgency clause which caused the bill to go into immediate effect. The reason for this urgency can be found in section 2 of Chapter 1115. (See Exhibit #1b, page 2)

As mentioned above, Assembly Bill 3396 was a single section bill which was enacted as introduced, never having been amended during legislative consideration. (See Exhibits #1a, #1b, and #2) Assembly Bill 3396 is described in the Third Reading analysis prepared by the Office of Senate Floor Analyses as follows:
This bill clarifies the purposes for which “excess” toll revenue on certain transportation projects constructed and operated by private entities under agreement with the Department of Transportation (Caltrans) may be used.
