Insurance Code section 10133 was added in 1951 following legislative passage of Senate Bill 1553. (See Exhibit #1e) The bill was introduced by Senator Hugh Byrne on January 23, 1951. (See Exhibit #1a) Senate Bill 1553 was a single- section bill affecting only section 10133. (See Exhibits #1b through #1e)
Senate Bill 1553 was assigned to the Senate Committee on Financial Institutions and the Assembly Committee on Finance and Insurance where policy issues raised by the bill were considered. (See Exhibit #2) Two amendments were made to Senate Bill 1553. (See Exhibits #1b, #1c and #2) Subsequent to legislative approval, Governor Earl Warren signed Senate Bill 1553, and it was recorded by the Secretary of State on May 23, 1951 as Chapter 563 of the Statutes of 1951. Legislative Counsel provides this digest of Senate Bill 1553 as enacted:
Authorizes insurer to pay hospital, medical or surgical expenses to those furnishing such services with prior written consent of insured. Such payments proportionately discharge insurer’s obligation.
Prohibits insurer from furnishing, participating in, or controlling such services.
