SENATE BILL 370 (BOWEN – 2005)

As enacted, Senate Bill 370 amended Elections Code section 15627 and added Elections Code section 19253, relating to electronic voting systems.  (See Exhibit #1e)  Senator Bowen introduced this bill on February 17, 2005.  (See Exhibit #1a)

Senate Bill 370 was assigned to the Senate Committee on Elections, Reapportionment and Constitutional Amendments and the Assembly Committee on Elections and Redistricting where policy issues raised by the bill were considered.  (See Exhibits #3 and #7)  The fiscal ramifications of the bill were considered by the Senate Committee on Appropriations and the Assembly Committee on Appropriations.  (See Exhibits #2 and #9)  Three amendments were made to Senate Bill 370.  (See Exhibits #1b through #1d and #2)  Subsequent to legislative approval, Governor Arnold Schwarzenegger signed Senate Bill 370 on October 7, 2005 and it was recorded by the Secretary of State as Chapter 724 of the Statutes of 2005.  (See Exhibits #1e and #2)

The Office of Senate Floor Analyses’ Unfinished Business analysis of Senate Bill 370 as last amended summarizes the provisions of Senate Bill 370 as follows:
 

This bill provides that on a direct recording electronic voting system, the electronic record of each vote shall be considered the official record of the vote, except that the voter-verified paper audit trail shall be the official paper audit record and shall be used in the manual tally and any recount, as specified.
