Public Resources Code sections 5549 and 5594 were amended in 1983 following legislative passage of Assembly Bill 746, which affected only these two sections. (See Exhibit #1d) This bill was introduced on February 18, 1983 by Assembly member Robert J. Campbell at the request of the East Bay Regional Park District. (See Exhibits #1a and #9, document PE-4)
Assembly Bill 746 was assigned to the Assembly Committee on Water, Parks and Wildlife and the Senate Committee on Natural Resources and Wildlife where policy issues raised by the bill were considered. (See Exhibits #3 and #5) Two amendments were made to Assembly Bill 746. (See Exhibits #1b, #1c, and #2) Subsequent to legislative approval, Governor George Deukmejian signed the bill on May 27, 1983 and it was recorded by the Secretary of State on that day as Chapter 48 of the Statutes of 1983. (See Exhibit #1d)
Assembly member Campbell explained to Governor Deukmejian that the purpose of the bill was to “assist the East Bay Regional Park District to more efficiently administer some of the routine matters that come before the general manager.” (See Exhibit #8, document A-2)
The Senate Republican Caucus prepared a Third Reading analysis of Assembly Bill 746 as last amended that described this bill as follows:
This bill, relating to a general manager’s powers to incur obligations on behalf of a regional park or open-space district, raises the limit from $5,000 to $10,000 for the payment of supplies, materials, labor, or other valuable consideration for any purpose other than new construction of any building, structure, or improvement.
AB 746 also increases the limit from $5,000 to $25,000 for the payment of supplies, materials, or labor for new construction of any building, structure, or improvement.
