Government Code section 65863.7 was amended in 1985 following passage of Senate Bill 316. (See Exhibit #1d) Senator Craven, who was serving as Chair of the Senate Select Committee on Mobilehomes, introduced the bill on February 4, 1985 at the request of the Golden State Mobilehome Owner’s League. (See Exhibits #3 and #16, document PE-2) Senate Bill 316 was a single-section bill that amended only Government Code section 65863.7. (See Exhibit #1d)
Senate Bill 316 was assigned to the Senate Committee on Housing and Urban Affairs and the Assembly Committee on Housing and Community Development where policy issues raised by the bill were considered. (See Exhibits #3 and #8) The fiscal ramifications of the bill were considered by the Senate Committee on Appropriations and the Assembly Committee on Ways and Means. (See Exhibits #2 and #10) Two amendments were made to Senate Bill 316 during legislative consideration. (See Exhibits #1b, #1c, and #2) Subsequent to legislative approval, Governor George Deukmejian signed Senate Bill 316 on September 30, 1980, and it was recorded by the Secretary of State on that date as Chapter 1260 of the Statutes of 1985. The Unfinished Business analysis summarized Senate Bill 316 as it was last amended on July 15, 1985:
DIGEST: This bill extends existing impact report requirements for mobilehome park conversions to include mobile home park closures or cessation of use unless this is a result of bankruptcy. This bill also provides for reimbursement to local government of additional costs incurred as a result of this bill.
Assembly Amendments:
1. Require that when the impact report is filed, the entity proposing the change shall provide a copy of the report to a resident of each mobilehome.
2. Specify that the entity filing the impact report or a park resident may request a hearing on the sufficiency of the report.
3. Specify that steps required to mitigate any adverse impact of the change shall not exceed the reasonable costs of relocation.
4. Make other technical changes.
