As enacted in 2000, Senate Bill 1696 only added section 31678.2 to the Government Code. (See Exhibit #1d) Assembly member Debra Ortiz introduced Senate Bill 1696 on February 22, 2000. (See Exhibit #1a) The State Association of County Retirement Systems (SACRS) was the sponsor of the bill. (See Exhibit #3, page 1) At this time, Senator Ortiz served as chair of the Senate Committee on Public Employment and Retirement. (Id.)
Senate Bill 1696 was assigned to the Senate Committee on Public Employment and Retirement and the Assembly Committee on Retirement and Social Security where policy issues raised by the bill were considered. (See Exhibits #3 and #7) Two amendments were made to Senate Bill 1696. (See Exhibits #1b, #1c, and #2) Subsequent to legislative approval, Governor Gray Davis signed Senate Bill 1696 on September 16, 2000, and it was recorded by the Secretary of State on September 19, 2000 as Chapter 495 of the Statutes of 2000. The Unfinished Business analysis of Senate Bill 1696 provided the following digest of the bill as it was last amended on May 18, 2000:
DIGEST : This bill allows a board of supervisors or a governing board of a district in counties operating retirement systems under the County Employees' Retirement Law of 19937 [sic] the option of applying an improved benefit formula to service credit earned prior to the adoption of the formula.
Assembly Amendments provide that a board of supervisors or a governing board of a district must adopt, by a majority vote, a resolution adopting the option described above.
