ASSEMBLY BILL 860 (UNRUH – 1967)

Business and Professions Code section 7551 and Penal Code sections 591 and 620 were amended, and sections 630, et seq., were added to the Penal Code, with Penal Code sections 619, 621, 640, 653h, 563i, and 653j repealed in 1967 following legislative approval of Assembly Bill 860.  (See Exhibit #1g)  Assembly member Jesse Unruh introduced Assembly Bill 860, relating to invasion of privacy, on March 1, 1967 in order to revise the existing provisions of the Penal Code on wiretapping.  (See Exhibits #1a and #3)  At this time, Assembly member Unruh served as Speaker of the Assembly.  (See Exhibit #7, document PE-1)

The Assembly Committee on Criminal Procedure and the Senate Committee on Judiciary heard the measure.  (See Exhibits #3 and #4)  Assembly Bill 860 was amended twice in the Assembly and three times in the Senate.  (See Exhibits #1b through #1f and #2)  Upon approval of the Legislature the bill went before the Governor for his signature.  (See Exhibit #2)  Assembly Bill 860 was signed by Governor Ronald Reagan on August 28, 1967 and recorded by the Secretary of State on that date as Chapter 1509 of the Statutes of 1967.  (See Exhibits #1g and #2)

Describing Assembly Bill 860 as it reached the Governor, Assembly member Unruh stated, in part:

Assembly Bill 860 recodifies California penal law relating to invasions of the privacy of confidential communications so that all such provisions of law appear within Chapter 1.5 of Title 15 of Part 1 of the Penal Code, entitled “Invasion of Privacy”.  Heretofore these sections have been randomly scattered throughout the Code. . . .
