Assembly Bill 1381 (Speier – 1995)

In 1995, Assembly Bill 1381 repealed Civil Code section 1795.8 and amended and added other sections of the Civil and Vehicle Codes to revise and recast the “Automotive Consumer Notification Act.”  (See Exhibit #1i) Assembly member Jackie Speier introduced this legislation on February 24, 1995 at the request of the California Motor Car Dealers Association.  (See Exhibits #1 and #3a, page 3) 

 

Following its introduction, Assembly Bill 1381 was assigned to the Assembly Committee on Transportation and the Assembly Committee on Appropriations.  (See Exhibits #3 and #5)  The Assembly amended the bill on April 5 and April 26, 1995.  (See Exhibits #1b, #1c, and #2)  Assembly Bill 1381 was approved by the Assembly and forwarded to the Senate on June 1, 1995.  (See Exhibit #2)

 

While in the Senate, the Committee on Judiciary and the Committee on Appropriations heard the measure.  (See Exhibits #10 and #12)  The Senate made five amendments to Assembly Bill 1381 during June, July and August of 1995.  (See Exhibits #1d through #1h and #2)  The Senate thereafter approved the bill and returned it to the Assembly.  (See Exhibit #2)

 

The Assembly approved the Senate amendments and Assembly Bill 1381 was forwarded to the Governor on September 5, 1995. Governor Pete Wilson

signed the bill on October 3, 1995, and it was recorded by the Secretary of State the following day as Chapter 503 of the Statutes of 1995.  (See Exhibits #1i and #2)

 

The purpose of Assembly Bill 1381 as noted in the Senate Committee on Judiciary analysis “. . .is to make it easier for car dealers to comply with the requirements of the state’s lemon disclosure laws.”  (See Exhibit #10b, page 4)

 

A description of Assembly Bill 1381 was provided in an Author’s Statement entitled “Concurrence in Senate Amendments” as follows:

 

AB 1381 IMPROVES DISCLOSURES THAT MUST BE PROVIDED TO CAR BUYERS WHEN A DEALER RESELLS A VEHICLE PREVIOUSLY REPURCHASED FROM THE ORIGINAL OWNER BY THE MANUFACTURER.
