Senate Bill 1057 (Cologne – 1967)

As enacted in 1967, Senate Bill 1057 amended Civil Code section 3287 and Code of Civil Procedure section 1033, relating to interest on judgments.  (See Exhibit #1c)  Senator Gordon Cologne introduced Senate Bill 1057 at the request of several of his constituents.  (See Exhibits #3 and #4, document PE-5)

Both the Senate and Assembly Committees on Judiciary heard the measure.  (See Exhibits #2 and #3)  One amendment was made to Senate Bill 1057.  (See Exhibits #1b and #2) Subsequent to approval by both Houses of the Legislature, Senate Bill 1057 was signed by Governor Ronald Reagan and recorded by the Secretary of State as Chapter 1230 of the Statutes of 1967.  (See Exhibits #1c and #2)

A Bill Memorandum to the Governor prepared by the Legislative Secretaries of both Houses provided a description of Senate Bill 1057, stating:

Senate Bill 1057 authorizes a court in its discretion to permit recovery of interest on any judgment for damages based upon a cause of action in contract where the claim is unliquidated from a date prior to entry of judgment, but not earlier than date action was filed.
