NEWS AND NOTES


LATEST FEDERAL ENACTMENTS:   It may seem as though there is more campaigning going on than governance at the federal level, but there are bills being debated, passed in both Chambers of Congress, and signed into law by the President.  Some of these bills recently signed by President Obama are as follows:
  • HR 3606, “Jumpstart our Business Startups,” introduced on December 8, 2011 by Rep. Stephen Fincher of Tennessee (R) and signed into law on April 5, 2012, was enacted to increase American job creation and economic growth by improving access to the public capital markets for emerging growth companies.  
  • HR 3630, “Middle Class Tax Relief and Job Creation Act of 2012,” introduced on December 9, 2011 by Rep. Dave Camp of Michigan (R) and signed into law on February 22, 2012 to provide incentives for the creation of jobs, such as extending the payroll tax reduction and providing for unemployment benefit continuation and program improvements.
  • HR 4281, “Surface Transportation Extension Act of 2012,” introduced on March 28, 2012 by Rep. John Mica of Florida (R) and signed into law on March 30, 2012, was enacted to provide an extension of Federal-aid highway, highway safety, motor carrier safety, transit, and other programs funded out of the Highway Trust Fund pending enactment of a multiyear law reauthorizing such programs.
  • S. 2038, “Stop Trading on Congressional Knowledge Act of 2012 (STOCK Act),” introduced on January 26, 2012 by Sen. Joe Lieberman of Connecticut (I) and signed into law on April 4, 2012 to prohibit members of Congress and employees of Congress from using nonpublic information derived from their official positions for personal benefit.

PENDING FEDERAL BILLS:  There are a number of measures currently before Congress being debated, such as the following three pending bills:
  • HR 4133, “United States-Israel Enhanced Security Cooperation Act of 2012,” introduced on March 5, 2012 by Rep. Eric Cantor (R) to express the sense of Congress that the U.S. should take specified actions to assist in Israel’s defense.  The bill passed out of the House Foreign Affairs Committee and on May 10, 2012 was referred to the Senate Committee on Foreign Relations.  
  • HR 5652, “Sequester Replacement Reconciliation Act of 2012,” introduced on May 9, 2012 by Rep. Paul Ryan (R) to amend the American Recovery and Reinvestment Act of 2009 to terminate the increase in the value of supplemental nutrition assistance program benefits for Puerto Rico and American Samoa on June 30, 2012, to amend the Patient Protection and Affordable Care Act by repealing various provisions relating to the American Health Benefit Exchange, the Prevention and Public Health Fund, and the Consumer Operated and Oriented Plan program, and to amend the Dodd-Frank Wall Street Reform and Consumer Protection Act to repeal authority for judicial procedures for the orderly liquidation of certain financial companies and the Orderly Liquidation Fund, among other changes.  As of May 15, 2012, the bill was placed on the Senate Legislative Calendar.  
  • S. 2343, “Stop the Student Loan Interest Rate Hike Act of 2012,” introduced on April 24, 2012 by Sen. Harry Reid (D) to make the 3.4% interest rate on Direct Stafford loans first disbursed to undergrads between July 1, 2011 and July 1, 2012, applicable to Direct Stafford loans first disbursed to undergrads between July 1, 2011 and July 1, 2013, and to amend the Internal Revenue Code and the Social Security Act to require certain shareholders of a subchapter S corporation engaged as a partner in a professional service business to include income or loss attributable to such business in their net earnings from self-employment for employment tax purposes, among other changes.  On May 16, 2012, there was a motion to proceed to consideration of the bill made in the Senate
